11/19/2009 - Federal Association Loan Purchase and Servicing [Bundesvereinigung Kreditankauf und Servicing e.V.] (BKS): Ombudsman Proceedings

Berlin, October 01, 2009
The ombudsman Dr. h.c. Gerd Nobbe, appointed by the Federal Association Loan Purchase and Servicing (BKS) in May 2009, will take up his work on October 01, 2009.
From now on, consumers have the opportunity as borrowers to have the independent ombudsman review their case if they do not agree with the approach of one of the member companies of BKS in the cases listed in the ombudsman statutes. The basis for this is the Code of Conduct passed by the BKS member companies.
BKS President Jörg Keibel comments on this as follows: “Due to Dr. Nobbe’s profession and his long-term experience as former chief judge at the Federal Court of Justice, a neutral and competent approach and evaluation of cases is guaranteed besides absolute impartiality, in particular in case of non-performing loans purchased by the members of BKS. We take these proceedings very seriously, since the possibility of an extrajudicial settlement on the basis of the recommendation by a neutral person may have advantages for both parties to the agreement.“
During the past months, BKS worked out the technical implementation of the process.
Consumers can direct their request to the BKS office in Berlin, from where the request is then forwarded to the ombudsman. A questionnaire for gathering some basic information can be downloaded on the BKS website under www.bks-ev.de. Further information about proceedings can be found on the website as well.
